This website is operated by Mufasa Tours and Travels. Throughout the site, the terms “we”, “us” and “our” refer to Mufasa Tours and Travels. Mufasa Tours and Travels offers this website, including all information products, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the website shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are an adult in your state or province of residence, or that you are an adult in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 – YOUR ELIGIBILITY

You must be an individual, 18 years of age or older. If you are under 18 years of age, you may use Mufasa Tous and Travels only with the involvement of a parent or legal guardian.

SECTION 4 – YOUR RESPONSIBILITY

Before making reservations, it is your responsibility to read the fine print associated with your desired product including, but not limited to, the following sections: Pricing and its notice, Tour Itinerary, Package Includes, Package Excludes, Cancellation and Refund Policy, Terms and Conditions, Special Note, etc.. And you herein state that you have read and fully understand the content of all fine print and will waive the right to dispute any part of it after your purchase.

Once you have completed your reservation, it is the customer’s responsibility to keep all contact information up-to-date.

SECTION 5 – TRAVEL INSURANCE

Mufasa Tous and Travels strongly recommend our customers acquire insurance covering medical, trip cancellation, baggage, etc. Mufasa Tous and Travels does not currently offer any travel  Insurance arrangements. Mufasa Tous and Travels shall be exempt from any liability in the event of an accident resulting in, but not limited to, loss or damage of properties, injury to people, death during a trip, delays, irregularities, or other occurrences beyond its control. You agree that Mufasa Tous and Travels will not be liable for any costs or damages arising out of a dispute or disagreement between you and any participating provider or a third party for anything that is in any way related to this site or the use of the information contained in this site, and you hereby expressively waive any such claim against Mufasa Tous and Travels and its owner, members, officers, directors, employees, parents, subsidiaries, agents and representatives. Mufasa Tous and Travels suggest that due to the Cancellation Policy for your tour and the unexpected events that can possibly occur, your party would benefit from purchasing Travel Insurance for your reservation.

SECTION 6 – TOUR AMENDMENTS AND CANCELLATION

Mufasa Tous and Travels will try its best to make sure all the tour arrangements will be the same as planned. However, to ensure safe and secure tours, Mufasa Tous and Travels reserves the right to make amendments including altering, postponing, and canceling tours due to weather, transportation, riots, and many other uncontrollable circumstances.

SECTION 7 – LANGUAGE

Tours are escorted by professional English-speaking tour guides and/or driver guides. In order to meet the language needs of the majority of passengers on a tour coach, tours and/or languages may be combined to enable the operation of the tours.

Travelers may request a guide who speaks a language other than English at an additional cost. The availability of such guides is subject to the destination’s availability, and the cost may vary based on the language proficiency of the guide and the duration of the service. The traveler must inform us of their language preference at the time of booking, and we will do our best to accommodate the request; however, we cannot guarantee the availability of guides speaking all languages.

SECTION 8 – PASSPORTS AND VISAS

You are responsible for obtaining any travel documents and/or verifying entry requirements necessary for each country of travel and/or transit on your selected tour itinerary. Entry laws differ with respect to travelers’ citizenship. Mufasa Tous and Travels cannot obtain personal travel documents for customers or assume responsibility for notice of current requirements on any given country. You are responsible for any expenses incurred as a result of delays or itinerary changes related to your lack of appropriate travel documents.

You should strictly abide by the laws and regulations promulgated by the government of the visiting country including but not limited to immigration and Customs Laws and Regulations. Mufasa Tous and Travels will not be responsible for any penalties due to your failure to abide by any regulations of the government of the visiting country.

SECTION 9 – PAYMENT POLICY

Please be aware all prices are offered in the currency of United States Dollars. Prices may vary due to availability. For example, prices may increase during holidays. All prices are subject to confirmation.

A deposit of 30% is required on bookings of any tour arrangement; the balance is to be paid 30 days after the commencement of the tour.

Payment in full is required where bookings are made less than 7 days before the tour begins. Further details about Mufasa Tous and Travels’ payment practices are described in our payment Policy. Mufasa Tous and Travels Payment Policy is part of this Agreement, and you agree that you have read and approved of all its content before making an online reservation.

SECTION 10 – TRANSPORTATION & DRIVER/GUIDES

We offer transportation in a range of vehicles, including cars, safari minibusses, tour vans, land cruisers, and coaches, based on the itinerary and the number of clients. As part of our commitment to providing an exceptional safari experience, we ensure that all clients are guaranteed a window seat during their safari excursion.

SECTION 11 – DELEGATION OF DUTIES

Mufasa Tours and Travels reserves the right to delegate any or all of its obligations under this agreement to third-party contractors or subcontractors without prior notice to the customer. The customer acknowledges and agrees that Mufasa Tours and Travels shall remain responsible for the performance of the services and that any subcontractors engaged by Mufasa Tours and Travels will be qualified and capable of performing the services. The customer further acknowledges and agrees that Mufasa Tours and Travels shall not be liable for any act or omission of any subcontractor or third-party contractor engaged by Mufasa Tours and Travels.

SECTION 12 -AMENDMENT, CANCELLATION, AND REFUND POLICY

Further details about Mufasa Tous and Travels cancellation and refund practices are described in Amendment, Cancellation and Refund Policy. Mufasa Tous and Travels Amendment, Cancellation, and Refund Policy is part of this Agreement, and you agree that you have read and approved of all its content before making an online reservation.

SECTION 13 – AIRPORT TRANSFERS/ FLIGHT INFORMATION

Flight information must be provided in order for the airport transfer services to be arranged. At our discretion, if flight information is not provided or provided last minute, your reservation will be noted as a self-transfer and no airport transfer services will be arranged. If you decide to self-transfer to the tour’s first night’s hotel, please inform us at your earliest convenience. If you opt out of a transfer service, you may reinstate the airport transfer service if notification to reinstate the service is given well in advance of the tour’s departure. Urgent requests to reinstate airport transfer services cannot be guaranteed. If a flight is delayed, Mufasa Tous and Travels will attempt to arrange a later airport transfer service, however, this later service is not guaranteed. If an airport transfer service is not available and cannot be provided, all guests are responsible for self-transferring to the tour’s first night’s hotel.

SECTION 14 – ACCOMMODATION

Accommodation is based on two persons sharing a twin room. Where possible rooms with private baths are requested. Single rooms are available at an additional cost.

We do not guarantee single rooms, particularly for a request of more than two single rooms with a private bath.

Hotel/lodges /Camps are categorized as an indication of class and rooms may be reserved at similar hotels/lodges/camps.

SECTION 17 – CHARGEBACK

You hereby waive any objection you may have to Mufasa Tous and Travels’ use of electronic records with Discover, MasterCard, Visa, American Express, or banks that issue credit cards should it be necessary for Mufasa Tous and Travels to respond to a chargeback. You agree that Mufasa Tous and Travels does business electronically by email, so email is accepted as the form of delivery of the services provided by Mufasa Tous and Travels. You are not ordering tickets to be delivered in person or by mail, so you agree to accept email as the form of delivery and instructs Discover, MasterCard, Visa, American Express, and banks that issue credit cards that email delivery constitutes delivery of services in this transaction.

You agree not to dispute a credit card charge on the basis of services not rendered if Mufasa Tous and Travels can prove that the E-Ticket was sent by email (by providing electronic proof that the E-Ticket was sent at a specific date and time as recorded by Mufasa Tous and Travel’s computer system. You agree that you will not dispute any charge improperly. This includes filing chargebacks claiming fraud if you claim the name of Mufasa Tous and Travels was not recognized by you. In the event you file a chargeback improperly, you agree to provide a written statement to the credit card company confirming the charge is correct and should be paid and agree to send an Email copy of this letter to Mufasa Tous and Travels, Attention: Chargeback, Mufasa Tous and Travels.

In the event legal action is necessary for by Mufasa Tous and Travels to collect money taken away from Mufasa Tous and Travels through a chargeback or to collect the Chargeback Fee, you agree to pay Mufasa Tous and Travel’s legal expenses if Mufasa Tous and Travels win the lawsuit.

SECTION 18 – MEDICAL CONDITIONS, PREGNANCY, AND TRAVEL

If you have a medical condition, or if you are pregnant and considering travel, you must consult with your doctor before you travel, especially if your medical condition requires daily routine care, urgent care, or your pregnancy is high-risk. You are responsible for disclosing any related information to us during the check-out process by adding special comments. You understand Mufasa Tous and Travels or a local provider is not in a position to provide any medical services or urgent care in the event such an action may be required. You are liable for any risks, incidences or consequences incurred during travel. We highly recommend that you purchase medical insurance and travel insurance before you travel.

SECTION 19 – DISABILITIES AND TRAVEL

We embrace all people, regardless of color or physical condition. One of our goals is to provide free access and expand travel opportunities for people with special needs in the United States and abroad. We are exploring more travel products to accommodate this special population; however, yet, not all the travel products we currently offer include special accommodations. You are responsible to verify with us before you book travel to ensure that special arrangement can be made if it is required for your needs. Mufasa Tous and Travels or a local provider is not liable for any incidences or consequences incurred during travel or complaints or lawsuits during or after travel due to your failure to inform us of your special needs. You also have the responsibility to re-confirm with us, after we reserve seats for you, that special accommodation will be provided per your request.

SECTION 20 – ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if the information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

SECTION 21 – MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display the colors and images of our products that appear at the store as accurately as possible. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or service pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 23 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools” as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Certain content, products, and services available via our Service may include materials from third parties.

Mufasa Tours and Travels is the sole owner of the information collected on this website. We will not sell or share this information to any outside parties, except as outlined in this policy. Mufasa Tours and Travels collects information from our users at several different points on our website in order to process reservations and better serve you with pertinent information. Information collected includes name, shipping address, billing address, telephone numbers, email address and payment information such as credit card. Mufasa Tours and Travels also requires you to submit a username and password of your choice for future access to your information. Your username and password is to remain confidential and you should not share this information with anyone. Mufasa Tous and Travel’s information practices are further described in its Privacy and Security Policy. Mufasa Tous and Travel’s Privacy and Security Policy is part of this Agreement, and you agree that use of data as described in the Privacy and Security Policy is not an actionable breach of your privacy or publicity rights.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. In no case shall Mufasa Tours and Travels, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Mufasa Tours and Travels and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third party.

SECTION 32 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 34 – ENTIRE AGREEMENT

Mufasa Tous and Travel’s failure to insist upon or enforce strict performance of any provision of the Agreement shall not be construed as a waiver of any provision or right.

Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture, or agency relationship between Mufasa Tous and Travels and the product providers or between Mufasa Tous and Travels and any other of its Corporate Partners. Neither the product providers nor any Corporate Partner shall have the ability to create any obligation on Mufasa Tous and Travel’s behalf.

This Agreement constitutes the entire agreement between you and Mufasa Tous and Travels with respect to the use of mufasatoursandtravels.com and constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 35 – GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Kenya, without reference to conflicts of law rules. As a condition of the use of the Mufasa Tous and Travels website and service, you (the Customer) agree to submit to the personal and exclusive jurisdiction of the courts located within Kenya and therefore agree to file any grievance or suit of any kind exclusively in the courts located within Kenya. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect.
